General Terms and Conditions of Sale

Introduction

Kihomi Safari Limited, a French–Maasai tour operator based in Tanzania, specializes in safari experiences and stays in Zanzibar.
We offer tailor-made journeys that combine wildlife discovery, cultural immersion, and beach relaxation.

True to our values, we actively support local communities by allocating a portion of our profits to development projects in Maasai villages and other rural areas.

The terms and conditions set out below apply to all safari services offered by Kihomi Safari Limited.

1. Booking and payment

1.1 Booking Confirmation: A booking with Kihomi Safari is confirmed upon receipt of a 30% deposit of the total safari cost.

1.2 Final Payment: The remaining balance must be paid no later than 30 days prior to the start date of the safari.

1.3 Payment Methods: Payments may be made by bank transfer or any other mutually agreed method. All bank charges are the responsibility of the client.

1.4 Late Bookings: For bookings made less than 30 days before departure, full payment is required at the time of booking.

2. Prices 

2.1 Included in the Price:
• Accommodation according to the selected category (Essential, Comfort, Prestige).
• Meals and beverages as specified in the itinerary.
• Professional English- or French-speaking guide.
• National park entrance fees.
• Transportation in a 4x4 safari vehicle with a pop-up roof for optimal wildlife viewing.

2.2 Not Included in the Price:
• International flights.
• Travel insurance (mandatory).
• Tanzanian visa.
• Tips for guides and staff.
• Personal expenses such as souvenirs, alcoholic beverages, or additional meals not mentioned in the itinerary.

2.3 Price Adjustments:
Prices may be adjusted in the event of changes to government taxes, park entrance fees, fuel costs, or exchange rates. Clients will be informed of any adjustments prior to the final payment.

3. Modifications

3.1 Client-requested modifications
Any modification to the itinerary requested by the client after booking confirmation is subject to availability and may result in additional charges.

3.2 Modifications by Kihomi Safari
Kihomi Safari reserves the right to modify the itinerary in the event of force majeure (including adverse weather conditions, safety concerns, or unforeseen circumstances) in order to ensure the safety and comfort of the participants. Equivalent alternatives will be proposed whenever possible.

4. Cancellations

4.1 Cancellation by the client
All cancellation requests must be submitted in writing to Kihomi Safari by email. The following cancellation fees apply:
• More than 60 days before the departure date: 10% of the total safari amount.
• Between 30 and 60 days before the departure date: 30% of the total safari amount.
• Less than 30 days before the departure date: 100% of the total safari amount.

4.2 Cancellation by Kihomi Safari
In the event of exceptional circumstances (such as political instability, natural disasters, or other unforeseen events), Kihomi Safari reserves the right to cancel a safari. In such cases, clients will receive a full refund or will be offered the option to reschedule their safari.

4.3 No-show
No refund will be granted if the client fails to appear at the agreed meeting point.

5. Travel Insurance 

Travel insurance is mandatory for all Kihomi Safari clients. It must cover medical expenses, accidents, trip cancellation, loss of personal belongings, and repatriation.

We recommend the travel insurance offered by Chapka Assurances, which is well-recognized and specifically adapted to travelers (clients benefit from a 5% discount through our agency).

However, clients may also check with their bank or usual insurance provider to verify the coverage included in their existing policies.

Kihomi Safari declines all responsibility for any costs, damages, or losses resulting from insufficient or inadequate insurance coverage.

6. Responsabilities

6.1 Responsibilities of Kihomi Safari
Kihomi Safari commits to providing the services described in the confirmed itinerary, within the limits of the agreements made with local service providers (guides, accommodations, transport companies, etc.).

However, Kihomi Safari cannot be held responsible for events beyond its direct control, including but not limited to:
• Flight delays or cancellations.
• Changes due to unforeseen weather conditions.
• Accidents, illnesses, or injuries occurring during the trip.
• Loss or theft of personal belongings.
• Strikes, political instability, or other cases of force majeure.

In such cases, Kihomi Safari will make every reasonable effort to offer suitable alternative solutions; however, any additional costs incurred shall be borne by the client.

6.2 Responsibilities of the client
Clients are required to:
• Ensure the validity of their travel documents, including a passport valid for at least six (6) months after the return date and the appropriate visa for Tanzania.
• Comply with local laws, customs, and all instructions provided by the guide or Kihomi Safari staff.
• Take out travel insurance covering medical expenses, trip cancellation, and repatriation.
• Inform Kihomi Safari at the time of booking of any medical condition, allergy, or special requirement that may require specific attention during the safari.

Kihomi Safari cannot be held responsible for any consequences resulting from the client’s failure to comply with these obligations.

6.3 Limitation of liability
In all cases, Kihomi Safari’s liability is strictly limited to the amount paid by the client for the booked services. No additional compensation may be claimed for indirect, incidental, or unforeseen losses.

7. Complaints

Les clients qui souhaitent soumettre une réclamation concernant les services fournis doivent en informer immédiatement leur guide ou l’équipe de Kihomi Safari afin de permettre une résolution rapide sur place. Toute réclamation formelle doit être adressée par écrit à Kihomi Safari dans un délai de 14 jours après la fin du safari. Passé ce délai, aucune réclamation ne sera prise en compte. Kihomi Safari s’engage à examiner chaque réclamation avec soin et à fournir une réponse dans un délai raisonnable.

8. Data Protection

Kihomi Safari complies with applicable personal data protection laws. Information provided by clients at the time of booking is used solely for the organization and management of safari services.

Such information will not be shared with third parties, except where necessary for the proper execution of the services (accommodations, guides, transport providers, etc.).

Clients have the right to access, rectify, and request the deletion of their personal data by contacting Kihomi Safari directly.

9. Applicable Law and Jurisdiction

These Terms and Conditions are governed by the laws in force in Tanzania.

In the event of a dispute, the parties agree to seek an amicable settlement before initiating any legal proceedings. If no resolution is reached, any dispute shall be submitted to the competent courts of Tanzania.

10. Ethical and Environmental Commitment

Kihomi Safari promotes responsible tourism and is committed to minimizing its environmental impact.

Clients are encouraged to respect local wildlife and flora, to leave no waste in national parks, and to avoid any interaction that could disturb animals or damage natural ecosystems.

Kihomi Safari also promotes respectful behavior toward local communities and cultural traditions, in line with sustainable and ethical travel practices.

11. Installment Payments

Kihomi Safari offers installment payment options to provide greater flexibility to its clients. The number of authorized payments depends on the booking date in relation to the safari departure date.

1. Bookings made 11 months or more before the departure date

Clients may pay for their safari in up to 10 monthly installments.

Payment structure:
• First payment (10%): Due at the time of booking to confirm the reservation.
• Regular monthly payments: The remaining balance is spread over a maximum of 9 additional installments.
• Final payment: The full remaining balance must be paid 30 days before the departure date.

2. Bookings made less than 11 months before the departure date

Clients may pay for their safari in up to 5 installments.

Payment structure:
• First payment (30%): Due at the time of booking.
• Subsequent payments: The remaining balance is spread over a maximum of 4 installments, according to an agreed schedule.
• Final payment: The full remaining balance must be paid 30 days before the departure date.

3. Last-minute bookings (less than 30 days before departure)

Bookings made less than 30 days before the departure date must be paid in full at the time of booking.

4. General Conditions for Installment Payments

4.1 Payment methods
• Payments must be made by bank transfer or any other payment method accepted by Kihomi Safari.
• All bank charges are borne by the client.

4.2 Payment schedule and commitment
• A detailed payment schedule specifying amounts and due dates will be communicated to the client at the time of booking.
• The client must sign an installment payment agreement confirming their commitment to respect the payment deadlines.

4.3 Late payments and penalties
• In the event of a delay exceeding 7 days, a penalty of 5% will be applied to the outstanding amount.
• If two consecutive payments are missed, the booking will be cancelled with no refund of amounts already paid.

4.4 Cancellation and refunds
• Payments made are non-refundable in the event of cancellation by the client.
• In the event of cancellation by Kihomi Safari, a full refund or an alternative solution will be offered.

12. Acceptance of the Terms and Conditions

By confirming a booking with Kihomi Safari, the client acknowledges having read, understood, and accepted these Terms and Conditions in full, without reservation.

These Terms and Conditions apply to all services provided by Kihomi Safari and form an integral part of the contractual agreement between the client and Kihomi Safari.
